Terms of Service and End User Licence Agreement

1. What these Terms cover
These Terms govern your use of
- the Pallas launcher for Windows,
- the Pallas Fabric mod that the launcher installs,
- the Pallas online services at
api.pallasclient.com(presence, badges, cosmetics, emotes, entitlements, capes), - the website
pallasclient.com.
They do not govern your purchase of cosmetics or emotes — see section 3.
They become part of our agreement when you accept them in the launcher before you sign in for the first time. If you do not accept them, do not use Pallas.
2. Minecraft is not ours
NOT AN OFFICIAL MINECRAFT PRODUCT. NOT APPROVED BY OR ASSOCIATED WITH MOJANG OR MICROSOFT.
Pallas is an independent launcher and modification for Minecraft: Java Edition. You need your own, valid Minecraft: Java Edition account to use it. "Minecraft" is a trademark of Mojang Synergies AB.
You remain bound by Mojang's own rules. The Minecraft End User Licence Agreement and the Minecraft Usage Guidelines apply to you directly. We are not a party to that agreement and cannot grant you anything Mojang has not granted you. If Mojang's rules and these Terms ever conflict about what you may do inside Minecraft, Mojang's rules win.
3. Buying cosmetics and emotes — your contract is with Tebex
Sold by Tebex Limited (UK), the merchant of record. Prices include VAT.
Cosmetics and emotes in the Pallas store are sold by Tebex Limited, Company No. 08129184, registered in England and Wales. When you buy, your contract is with Tebex, not with us. Tebex takes payment, issues the confirmation, handles refunds and chargebacks, and is your contract partner for everything about the purchase. Their terms apply: https://checkout.tebex.io/terms.
We build and deliver the content, and we unlock it on your Minecraft UUID once Tebex tells us your purchase went through.
Right of withdrawal. If you are a consumer in the EU or the UK, you have a statutory right of withdrawal of 14 days for digital content. Under § 356(6) no. 2 BGB that right ends before the 14 days are up only if all of the following happened: delivery had begun, you expressly agreed that it should begin before the withdrawal period ends, you confirmed that you know your right of withdrawal ends when delivery begins, and you received the confirmation required by § 312f BGB. Tebex asks for that consent and confirmation during checkout, and Tebex — not we — owes you the formal withdrawal instructions. If those steps did not happen, your right of withdrawal continues to exist.
We do not exclude, shorten or replace any of this. Any statement anywhere in the Pallas product that suggests purchases are "final" or "non-refundable" is wrong and does not apply against a consumer's mandatory rights.
Gifts. If you buy an item as a gift, the recipient gets the right to use it. The right of withdrawal and any refund belong to you, the buyer.
Minors. If you are under 18, you may only buy from the Pallas store with the permission of a parent or guardian, and only with money they have given you to spend freely (§§ 106 ff., § 110 BGB).
4. What you get: a licence, not ownership
For the launcher, the mod and every cosmetic, emote, cape or other content you unlock, we grant you a non-exclusive, non-transferable, revocable right of use for private, non-commercial purposes, for as long as you have an account in good standing and the item exists.
This is a licence, not a sale of the item itself. In particular:
- The content, the software and everything in them stays ours or our licensors'.
- Your entitlements are tied to your Minecraft UUID. They cannot be sold, traded, transferred, lent, rented or given to another account, and they have no monetary value outside Pallas.
- You may not resell, sublicense, redistribute, decompile, disassemble or reverse-engineer the launcher, the mod or the content, except where the law expressly allows it (for example §§ 69d, 69e UrhG).
- You may not extract Pallas cosmetics or emote data and ship them in another product.
- You may not use Pallas to cheat, to attack other players or servers, or to break the rules of any server you join.
Open-source components inside Pallas keep their own licences, which override this section for those components. The full list ships with the launcher and is at /licenses.
5. Rules for using the online services
Do not:
- upload capes or other content you have no rights to, or that is illegal, hateful, sexual, violent, or that shows other people's personal data;
- impersonate somebody else;
- automate, scrape, overload or attack the Pallas services;
- circumvent the entitlement system, or share, resell or fake entitlements;
- use Pallas features on a server where they break that server's rules.
Your uploads are your responsibility. You are responsible for the content you upload — in particular custom capes — and you confirm that you hold all necessary rights to it. If a third party raises a claim against us because of content you uploaded, and you are responsible for that, you will indemnify us against justified claims.
Reporting unlawful content. If you see a published cape that is unlawful or breaks these rules, report it to support@pallasclient.com with the cape or the player name. We look at every report, and we tell you and the person affected what we decided and why (Art. 16, 17 Digital Services Act). We keep a log of every moderation decision. If you think we got it wrong, write to the same address; we answer within 14 days.
Server rules. Some servers forbid features that Pallas can provide — minimaps and radar in particular. Pallas switches known rule-critical features off on servers we know about, but we cannot guarantee that a configuration is allowed on any given server, and we give no assurance about bans. Checking and obeying the rules of the server you join stays your job.
Transparency about what servers can see. The Pallas mod registers plugin message channels (cinder:hello, cinder:users, cinder:control) with every server you join. That means any server can detect that you are using Pallas, in the same way it can detect other client mods. We consider that normal and honest; we mention it so it is never a surprise.
6. What happens if you break the rules — graduated, not all-or-nothing
If you break these rules, we may, depending on how serious and how repeated the breach is: warn you, temporarily suspend online features, or permanently close your access to the Pallas online services.
Content you have paid for stays yours, except where the breach is directly connected to that content — for example, you obtained it fraudulently, charged back the payment, or used it to cheat or to attack other players.
We will tell you the reason. You can object by writing to support@pallasclient.com, and we answer within 14 days. If we got it wrong, we reverse the measure.
Your statutory rights, and any claim you may have against Tebex about a purchase, are not affected by a measure under this section.
7. Availability of the online services
We want Pallas to be there when you play, and the online services are a main part of what we owe you — not a free extra. But we do not promise a specific availability figure, and we are not liable for downtime outside our control (your internet connection, Mojang's services, a Minecraft server, a provider outage, force majeure).
We may carry out maintenance, and we will announce planned maintenance in advance where we reasonably can. The launcher, the mod, the HUD, cosmetics and emotes that are already installed keep working offline; only the online features (presence, badges of other players, unlocking new purchases) need our servers.
If we decide to discontinue the online services altogether, we will announce it at least three months in advance and tell you what happens to content you paid for.
8. Updates
We keep the launcher, the mod, the cosmetics and the emotes working with the Minecraft versions that Pallas supports, and we provide security updates. For a piece of content you buy, this commitment lasts for as long as Pallas supports the Minecraft version you bought it for, and in any case for at least 24 months from the date of purchase. When Mojang ships a Minecraft version that Pallas supports, we update purchased content to work with it. If a piece cannot be made to work again, we will tell you, and Tebex will refund it (§ 327f BGB).
The security support period for the software itself is five years from the date the product was placed on the market; the current end date is stated in our Security Policy.
Please install updates. The launcher tells you when an update is available and installs it over a signed channel. If you do not install an update, Pallas may stop working correctly, and we are not liable for defects that the update you declined would have fixed (§ 327f(2) BGB).
9. Content that leaves the store
If we take a cosmetic or an emote out of the store, people who already bought it keep it and keep getting it delivered. Removing something from sale is our decision; taking it away from a buyer without replacement would be a defect under § 327f BGB, and we do not do that.
10. Pallas writes to your Minecraft folders — please keep backups
To install the mod, manage mods, import your existing setup, migrate an older installation and share player data between instances, Pallas creates, moves, renames and deletes files and directories inside your Minecraft installation and in your user profile (including junction points on Windows).
We test these paths, but software has bugs.
**Please back up your Minecraft worlds and your
.minecraftfolder before you install Pallas and before any major update.** Deleting a screenshot from the Pallas gallery goes to the Recycle Bin, but world data lost through a failed import cannot be recovered by us.
This warning does not limit our liability; it is here so you can protect yourself.
11. Liability
We are liable without limitation:
- for damage arising from injury to life, body or health,
- for damage caused intentionally or by gross negligence,
- under the German Product Liability Act (Produkthaftungsgesetz) — a liability that cannot be excluded at all (§ 14 ProdHaftG),
- where we have given a guarantee, and
- for claims under the statutory rules on digital products (§§ 327 ff. BGB).
For slight negligence we are liable only where we breach an obligation that is essential to this agreement — an obligation whose fulfilment makes proper performance possible in the first place and on whose observance you may regularly rely. The clearest example here is our duty not to destroy your Minecraft data. In those cases our liability is limited to the foreseeable damage typical for this kind of agreement.
Any further liability for slight negligence is excluded.
We do not exclude or limit liability in any of the cases listed in § 309 no. 7 BGB, and nothing in these Terms should be read as trying to.
12. Young people
Pallas is for people aged 16 or older. You must be 16 or older to give consent for the optional features described in our Privacy Policy (usage statistics, crash reports, skin history, Discord Rich Presence, publishing a cape). The launcher does not ask your age; those features are off until you turn them on. If you are younger, please ask a parent or guardian.
If you are a minor, you need the agreement of your parent or guardian to enter into these Terms and to buy anything (§§ 106 ff. BGB).
13. Changes to these Terms
If we need to change these Terms, we will tell you at least six weeks in advance, in the launcher or by showing the new text at sign-in, and we will point out what changed and that you may object. If you do not object before the change takes effect, it applies; if you object, either of us may end the agreement. We will repeat this in the notice itself.
We will not use this to change what you already paid for.
14. Ending the agreement
You can stop using Pallas at any time — uninstall the launcher, and ask us to delete your data (see the Privacy Policy, section 10). We may end the agreement for good cause, in particular in the cases in section 6, and otherwise with reasonable notice.
15. Governing law, consumers, disputes
Governing law: German law applies to these Terms. If you are a consumer, you also keep the protection of the mandatory consumer-law rules of the country you live in — nothing here takes those away (Art. 6(2) Rome I Regulation (EC) No 593/2008).
Dispute resolution: We are not willing and not obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). For purchases, Tebex is your contract partner and Tebex's own dispute process applies.
No arbitration clause, no forum selection against consumers. If you are a consumer, you can sue us, and we can sue you, only in the courts the law gives us.
16. Odds and ends
If a provision of these Terms turns out to be invalid, the rest stays in force. The invalid provision is replaced by the statutory rule.
